The reserved-activity structure, and why the ceiling is harder
§3 RDG (Rechtsdienstleistungsgesetz) reserves the provision of legal services to admitted lawyers. You prepare, draft, calculate and file; you do not advise.
This mirrors the tax profession — with one decisive difference. A Steuerfachangestellte/r can climb all the way to Steuerberater through practice and exams, without a degree. There is no equivalent path to Rechtsanwalt. Admission requires a law degree and both Staatsexamen, full stop. The ladder here tops out at Rechtsfachwirt/in, and that is the ceiling.
Know this before you start. It is the single most important structural fact about the job.
What the job involves
- Fristenkontrolle — calculating and monitoring procedural deadlines. This is the core of the role and the core of the risk: a missed Frist is a malpractice claim against the firm, and deadline management is why the profession exists.
- Aktenführung — file management, now largely electronic
- beA — the besonderes elektronisches Anwaltspostfach. Electronic filing with courts has been mandatory for lawyers since 2022, and operating it is day-to-day work.
- RVG billing — fee calculation under the Rechtsanwaltsvergütungsgesetz, plus court cost schedules. Genuinely technical.
- Zwangsvollstreckung and Mahnverfahren — enforcement and dunning procedures
- Client contact, court correspondence, scheduling
The substance is ZPO — German civil procedure. That is what the job is made of.
Qualification route
- 3 years dual, in a Kanzlei plus Berufsschule
- Exam sits with the Rechtsanwaltskammer, not the IHK — a freier-Beruf profession
- Entry: mittlerer Schulabschluss typical
- Paid throughout: roughly €950–1,250/month gross, with wide regional variation
- Ladder: Rechtsfachwirt/in after several years’ practice — a substantial pay step and the route to Bürovorsteher/in (office manager). Beyond that, lateral moves into legal departments, courts, or compliance.
Pay
The profession’s structural complaint: high responsibility, modest pay, and an enormous spread by employer type. Approximate gross monthly, 2026 — market estimates, not tariff-verified; there is no widely binding collective agreement:
| Setting | Gross/month |
|---|---|
| Small Kanzlei, newly qualified | €2,400 – €3,000 |
| Small/mid Kanzlei, experienced | €3,000 – €3,800 |
| Rechtsfachwirt/in | €3,800 – €4,800 |
| Großkanzlei / international firm | €3,500 – €5,500 |
| Bürovorsteher/in, large firm | €4,500 – €6,000 |
Employer type matters more than experience. An international firm in Frankfurt, Düsseldorf or Munich can pay a newly qualified assistant what a small-town Kanzlei pays a Rechtsfachwirt, often with a 13th month and overtime paid rather than assumed. If pay is your priority, target the Großkanzleien deliberately.
Demand
Severe shortage. Training numbers have fallen for years while the deadline and filing workload has grown, and many firms simply cannot fill positions. Bargaining power for qualified candidates is unusually strong — better than the pay levels suggest.
Foreign candidates
- To work: no recognition legally required. The occupation is unregulated.
- For the visa: a Gleichwertigkeitsfeststellung, with the Rechtsanwaltskammer as the competent body — not IHK FOSA, since this is a freier-Beruf occupation.
- Foreign legal qualifications transfer poorly, and reasonably so. The job is ZPO, RVG and German court practice. A foreign law degree or paralegal qualification conveys little about any of it. Expect to learn the procedural system from scratch.
- Language: C1 in practice. Court correspondence, deadline instructions and client contact are linguistically demanding and unforgiving of error — alongside Steuerfachangestellte/r, the highest real language bar in this repo.
Pitfalls
- The ceiling is real. No degree, no admission — unlike the tax profession. Decide whether Rechtsfachwirt is a destination you want.
- Fristen liability is personal in practice, even though the firm carries the claim. A missed deadline is career-damaging.
- Small-Kanzlei overtime is frequently unpaid and assumed. Ask directly.
- ReNo vs. RA vs. Notar variants are different certificates with different scopes; the notarial side involves Beurkundung work and a different body of law.
