Two people can do the same public-sector job, at the same desk, and be employed under completely different legal systems with different pay, pensions, rights and restrictions. This is one of the largest structural facts in German working life, and nothing else in this repo works without it.
Not all public-sector staff are Beamte. Many do identical work as ordinary employees (Angestellte / Tarifbeschäftigte) under TVöD or TV-L, for materially less net pay.
The two statuses
| Beamte/r (civil servant) | Angestellte/r (employee) | |
|---|---|---|
| Legal basis | Public-law appointment (BeamtStG, state laws) | Employment contract |
| Pay system | Besoldung — A/B/R/W grades | Tariff — TVöD, TV-L |
| Pension | Ruhegehalt, paid by the state | Statutory pension (DRV) |
| Health cover | Private insurance + Beihilfe subsidy | Statutory insurance, split contributions |
| Right to strike | None | Yes |
| Job security | Effectively absolute once tenured | Ordinary dismissal protection |
| Dismissal | Only by disciplinary court proceedings | Normal employment law |
Why Beamte net far more than the gross suggests
A Beamter’s gross and an employee’s gross are not comparable numbers. Beamte pay:
- no pension contribution (the state pays the pension directly)
- no unemployment insurance contribution
- no employee health-insurance premium in the usual sense — Beihilfe covers roughly 50–70% of medical costs, and private insurance covers the remainder at a far lower premium than a full policy
The practical effect is large: on the same gross figure, a Beamter typically takes home several hundred euros more per month than an employee, and the gap widens with family status through the Familienzuschlag. Any comparison between a Besoldung figure and a tariff figure that ignores this is misleading.
The pension difference compounds it. Ruhegehalt reaches up to roughly 71.75% of final pensionable salary after a full career — far above what the statutory system replaces.
The grades
Besoldungsordnung A is the ordinary career scale, and rises by Erfahrungsstufen (experience steps), not by performance. Alongside it: B for senior leadership (fixed, no steps), R for judges and prosecutors, W for professors.
Careers run in Laufbahngruppen, each with its own entry qualification:
| Laufbahn | Typical grades | Entry |
|---|---|---|
| einfacher Dienst | A 2 – A 6 | Hauptschulabschluss |
| mittlerer Dienst | A 6 – A 9 | Mittlerer Schulabschluss + Vorbereitungsdienst |
| gehobener Dienst | A 9 – A 13 | Bachelor / FH degree, often a dual study programme |
| höherer Dienst | A 13 – A 16 | Master / Staatsexamen |
During the Vorbereitungsdienst you are an Anwärter/in on much lower Anwärterbezüge — in NRW 2026, €1,760 (A 12) and €1,793 (A 13).
Besoldung is state law, not federal
Since the 2006 Föderalismusreform, each Bundesland sets its own Besoldung. There are effectively seventeen systems — sixteen states plus the federal government — and they have diverged substantially. The same A 13 post pays noticeably differently in Bavaria, Berlin and Saxony, and the Stufen structures differ too.
Consequences: never quote “German Beamte pay” as a single figure, and understand that moving between states mid-career is a real financial decision, not an administrative one.
Who can become a Beamter — read this carefully
§7 BeamtStG restricts appointment to nationals of Germany, another EU member state, the EEA, or Switzerland. Third-country nationals can be appointed only where there is a dringendes dienstliches Bedürfnis — a narrow, discretionary exception that is not something to plan a career on.
For much of this repo’s likely audience, this is a hard stop. A qualified third-country teacher can be recognised, licensed and hired — as an Angestellte/r under TV-L, with lower net pay and the statutory pension, permanently, unless they naturalise.
Two further gates apply to everyone:
- Age limit at appointment — state-specific, commonly somewhere between 42 and 47. Career changers can age out.
- Amtsärztliche Untersuchung — a health assessment of your likely fitness to serve until retirement. It can and does result in refusal, and chronic conditions are a genuine risk factor.
Appointment then runs Beamter auf Probe (usually three years) before auf Lebenszeit.
The obligations people forget
- No right to strike. Confirmed for teachers by the Bundesverfassungsgericht in 2018.
- Nebentätigkeit — secondary employment requires permission.
- Political moderation duty (Mäßigungsgebot) and a duty of loyalty to the constitutional order.
- Transferability — your Dienstherr can assign you elsewhere within its remit.
- Residence and availability obligations in some services.
Where this matters in this repo
| Profession | English | Status |
|---|---|---|
| Lehrer/in | Teacher | Usually verbeamtet; Angestellte on TV-L where not |
| Notfallsanitäter/in | Paramedic | Verbeamtet only via the Berufsfeuerwehr route |
| Police, customs, tax administration, judges | Planned additions — see TODO.md |
