Versorgungswerke — the pension system for the Kammerberufe

Everyone in this repo pays into the Deutsche Rentenversicherung except one group, and that group contains several of its best-paid professions. Members of the Kammerberufe — doctors, dentists, vets, pharmacists, lawyers, notaries, architects, tax advisers, psychotherapists — are generally exempt from the statutory pension and belong to their profession’s own Versorgungswerk instead.

The repo already profiles Arzt and Apotheker, describes the ladders to Steuerberater and Rechtsanwalt, and adds Architekt — and until now mentioned this nowhere. It matters most to exactly the people this repo is written for: anyone arriving mid-career, and anyone who may leave Germany again.

What it is

A Versorgungswerk is a compulsory occupational pension institution attached to a professional chamber, established under state law. Join the chamber, join the Versorgungswerk. There are dozens — generally one per profession per Bundesland, sometimes shared across several states.

Deutsche Rentenversicherung Versorgungswerk
Financing Pay-as-you-go (Umlage) Funded — contributions are invested
Membership Employment-based Profession-based, via the Kammer
Contribution Fixed rate up to the ceiling Usually pegged to the same rate and ceiling
Employer share Half Half — the employer must pay it (§172a SGB VI)
Typical outcome Modest Materially higher for the same career
Insolvency backstop The federal government None comparable — state supervision only
Covers Old age, reduced earning capacity, survivors The same three, and Berufsunfähigkeit cover is often better

The reduced-earning-capacity point is worth separating out. The statutory system pays Erwerbsminderungsrente, which asks whether you can do any work. Most Versorgungswerke insure Berufsunfähigkeit — whether you can still practise your profession. For a surgeon with a hand injury or a dentist with a back, that is a different question with a different answer.

The exemption is applied for, not automatic

§6 Abs. 1 Nr. 1 SGB VI. If you are employed in a Kammerberuf, you are in the statutory system by default and must apply to be exempted:

  1. Join the Kammer and the Versorgungswerk.
  2. File the Befreiungsantrag through the Versorgungswerk, which passes it to the DRV.
  3. Within three months of starting the employment, or the exemption runs only from the date of application, leaving a gap paid into the wrong system.

The exemption is tied to the specific job, not to you. Following case law, it must be re-applied for on every change of employer, and on a material change of role with the same one. People who assume it carries over discover the gap years later.

Self-employed practice is different: outside the statutory system anyway for most of these professions, so the Versorgungswerk simply is the pension.

Contributions in practice

Most Versorgungswerke set the standard contribution at the statutory rate applied to the statutory ceiling, so an employed member pays roughly what a DRV member on the same salary would — half of it from the employer. Beyond that:

  • Voluntary over-payment is usually permitted, often up to a multiple of the standard contribution, and is the main reason Versorgungswerk pensions end up higher.
  • Contributions count as Altersvorsorgeaufwendungen for tax, like DRV contributions — see tax and net pay.
  • Reduced contributions are normal in the first years after qualification, and while in parental leave or a Weiterbildung post.

Moving: the three cases that go wrong

1. Between Bundesländer. A different state means a different Versorgungswerk. Most have Überleitungsabkommen that transfer the accrued entitlement — but typically only if you apply within a short window (commonly six months) of joining the new one. Miss it and you keep a frozen fragment in the old one and start again in the new. This is the single most common avoidable loss, and it affects doctors above all, who move states for Weiterbildung posts.

2. Between systems, inside Germany. Leave the profession — a doctor moving into industry or administration — and you stop contributing to the Versorgungswerk and resume DRV contributions. Nothing transfers. You end with two part-pensions, which is fine, unless neither reaches its own minimum qualifying period. The DRV needs five years of contributions before it pays anything at all, and Versorgungswerk years do not count toward it. A career split 4/25 can leave four years’ worth simply unpayable.

3. Leaving Germany. DRV contributions can, for non-EU nationals, be refunded after a waiting period. Versorgungswerke generally do not work that way. The usual options are:

  • leave the entitlement beitragsfrei and draw it at retirement from abroad — normally the best outcome, and the one to default to
  • continue voluntarily from abroad, which several permit
  • a partial refund of your own contributions, where the statutes allow it, commonly after a waiting period and often excluding the employer’s half

EU coordination (Reg. 883/2004) does cover Versorgungswerke, so periods count for entitlement elsewhere in the EU — but the practical handling is thinner than for the DRV, and outside the EU the bilateral social-security treaties frequently do not mention them at all. Check before you assume a treaty covers you.

Whatever you do: keep the membership number and the annual statement, and tell the Versorgungswerk your address abroad. Entitlements are not paid to people who cannot be found.

Who this applies to in this repo

Profession English Versorgungswerk
Arzt / Ärztin Physician Ärzteversorgung — the largest and oldest group
Apotheker/in Pharmacist Apothekerversorgung
Zahnarzt / Zahnärztin Dentist Zahnärzteversorgung
Psychotherapeut/in Psychotherapist Via the Psychotherapeutenkammer; arrangements vary by state
Architekt/in Architect Architektenversorgung in most states; joint schemes in others
Rechtsanwalt/-anwältin, Notar/in Rechtsanwaltsversorgung — reachable from Rechtsanwaltsfachangestellte/r
Steuerberater/in Steuerberaterversorgung — reachable from Steuerfachangestellte/r

Not every Kammerberuf has one in every Bundesland, and Wirtschaftsprüfer are a partial case — many are covered through the Steuerberater scheme rather than one of their own. Confirm with the chamber of the state you will actually practise in.

Checklist on arrival

  1. Register with the Kammer — this is not optional and precedes everything.
  2. Register with the Versorgungswerk.
  3. File the §6 Befreiungsantrag within three months of starting work.
  4. Re-file it on every job change.
  5. On moving Bundesland, apply for the Überleitung immediately.
  6. Keep the annual statement. It is the only record you will have if you leave.
